OPINION AND ORDER re 1 Complaint: Court grants the Motion to Dismiss as to the impairment of contract claim and dismisses Count I for failure to state a claim, without prejudice. Court will withhold ruling on this issue as requested by G ary Jet and will give the parties an opportunity to brief the issue of supplemental federal jurisdiction.
