ORDER: The Court GRANTS the Joint Motion for Turnover of Funds #64 and ORDERS the seized funds totaling $1,967,394.81, plus any accrued interest, less any debt owed to the United States, any agency of the United States, or less any other debt which the United States is authorized to collect from the Claimant, SHALL NOT BE FORFEITED, but shall be transferred from the United States Marshals Service to the Clerk of this Court, for the restitution ordered in Cause Number 2:18-CR-116-PPSAPR, United States v. Ubanwa. Claimants and Ubanwa hereby knowingly and voluntarily waive any and all right to reimbursement by the United States of reasonable attorney fees and litigation costs in connection with this civil forfeiture action. Claimants and Ubanwa release, remise and discharge plaintiff, the United States of America, and any of its agencies (as listed in this Order) involved in this matter. The respective parties will each bear their own costs, fees, and expenses and any attorneys fees. Claimants shall be responsible for and pay their own tax obligations, penalties, and liabilities, respectively, related to this agreed disposition.
