The court DISMISSES: (1) Count I in its entirety as to Chief Lands; (2) Count I as to Officer Ballas to the extent that it alleges due process violations, excessive force, and fa lse imputation; (3) Count II; (4) Count III; (5) Count IV; (6) Count V; (7) Count VI as to Officer Ballas; (8) Count VII; and (9) Count VIII Mr. Fosters § 1983 claims against Officer Ballas for unlawful search andseizure and false arrest and his state law false imprisonment claim against Chief Lands survive.
