OPINION AND ORDER denying 3 MOTION to Appoint Counsel and denying 4 Motion for Temporary Restraining Order. The court takes the 4 Motion for Prelminary Injunction under advisement. The plaintiff is granted leave to proceed against Unit Team M anager Mr. Thatcher in his official capacity for injuntive relief solely related to his claim that he is in imminent danger of serious physical injury because he is being housed with cats contrary to medical orders. All other claims are dismissed wit hout prejudice. Parties L Bratcher and D Cabanaw are dismissed. U.S. Marshals Service directed to effect service of process on Mr. Thatcher.
