Filing 20 OPINION AND ORDER: Court GRANTS IN PART AND DENIES IN PART 6 Partial Motion to Dismiss. Defendants' motion to dismiss is GRANTED as it relates to the following claims, which are now dismissed: Plaintiffs' Section 1983 claim against def endants Bill Raber, Steve Gough, James Walker, Bill Berkshire, and Chris Betzner; plaintiff's Section 1983 claim against the City of Peru; and plaintiff's Section 1983 claim against the City of Peru Police Department. Defendants' mot ion to dismiss is DENIED as it relates to plaintiff's state law battery claim against J.O. Buffington and Andrew Johnson. The only claims that remain in this case are plaintiff's state law battery claim and Section 1983 individual capacity claim against defendants Buffington and Johnson.
