Filing 61 OPINION AND ORDER GRANTING IN PART and DENYING IN PART 38 MOTION to Dismiss for Failure to State a Claim by Defendants Indiana Attorney General, Indiana Department of Corrections, Stan Knight, Bruce Lemmon, Ron Neal. The Motion is GRANTED in that ( 1) All claims against the Indiana Department of Correction are DISMISSED WITH PREJUDICE; (2) The official capacity claims against the Indiana Attorney General, Bruce Lemmon, Stan Knight and Ron Neal under 42 U.S.C. § 1983 are DISMISSED WITH PREJ UDICE; (3) The individual capacity claims against the Indiana Attorney General, Bruce Lemmon and Stan Knight under 42 U.S.C. § 1983 are DISMISSED WITHOUT PREJUDICE; (4) The Americans with Disabilities Act and Rehabilitation Act claims against th e Indiana Attorney General, Bruce Lemmon, Stan Knight and Ron Neal are DISMISSED WITH PREJUDICE. The Motion is DENIED with respect to the individual capacity claims under 42 U.S.C. § 1983 against Ron Neal. Plaintiffs GRANTED until 10/20/2016 to file an Amended Complaint.
