Filing 36 OPINION AND ORDER: The Court GRANTS in part and DENIES in part Defendants' motion for summary judgment. 26 Specifically, the Court grants summary judgment in favor of Drake as to Taylor's § 1983 false arrest claim on qualified imm unity grounds. The Court also grants summary judgment in favor of the City and the Department on Taylor's Monell claim. Finally, the Court dismisses Taylor's defamation claim pursuant to his own concession. The Court denies all other req uested relief, and so the following claims move forward: (1) Taylor's claims for false arrest and false imprisonment under Indiana law against all Defendants; (2) Taylor's § 1983 false arrest claim against Oberle; and (3) Taylors negligence-based claims against all Defendants. The Court will contact the parties to set a scheduling conference to explore the next steps in this case. Signed by Judge Jon E DeGuilio on 12/11/2018. (lhc) |
