OPINION AND ORDER: The Court GRANTS Richard Allen Cope leave to proceed against John Wilcher and Joseph Maksyan in their individual capacities for money damages, as outlined in Order; GRANTS him leave to proceed against Joseph Maksyan in his indi vidual capacity for money damages, as outlined in Order; GRANTS him leave to proceed against Joseph Maksyan on an injunctive relief claim for protective custody as required by the Eighth Amendment; DISMISSES Dan Reynolds, Derrick Allen, and John B oyd; DISMISSES, pursuant to 28:1915A(b)(1), all other claims and defendants; DIRECTS the clerk and the US Marshals Service to issue and serve process on John Wilcher and Joseph Maksyan at the LaPorte County Jail with a copy of this order and the am ended complaint 10 as required by 28:1915(d); and ORDERS, pursuant to 42:1997e(g)(2), that John Wilcher and Joseph Maksyan respond, as provided for in the Fed.R.Civ.P. and N.D.
