Filing 46 OPINION AND ORDER: The court GRANTS IN PART Sun & Chang's motion for partial summary judgment as to the FLSA claims and DENIES AS MOOT the motion as to the Indiana Wage Payment claims ECF 41 . The court DENIES AS MOOT the motion to amend the co mplaint ECF 31 , the motion for oral argument ECF 37 and the motion to extend discovery ECF 39 . Because federal question jurisdiction no longer exists, the court DISMISSES the remaining state law claims for lack of subject matter jurisdiction without prejudice to these claims being pursued in state court. This order terminates the case. Signed by Judge Damon R Leichty on 11/17/21. (nal) |
