Consistent with that plan, the Court now enters the instant Rule 16(b) Scheduling Order regarding the conduct of discovery and deadlines as outlined in order. Any motion challenging Plaintiffs jurisdictional allegations shall be filed on or before 6/26/2023, if deemed necessary. The parties will exchange the information required by Fed. R. Civ. P. 26(a)(1) by 5/26/2023. The last date for the parties to amend the pleadings without leave of court is 6/26/2023. The parties have agreed that the deadline for completion of non-expert discovery and discovery relating to liability and damages issues is 7/24/2023; and the deadline for completion of expert witness discovery is 11/28/2023. The serving of reports from retained experts under Rule 26(a)(2) are due from plaintiff(s) by 9/26/2023; and from defendant(s) thirty days after Plaintiffs expert disclosure, or 10/26/2023, whichever is earlier. Supplementation under Rule 26(e) is due every six weeks until trial. The last date for the completion of ALL DISCOVERY is 12/22/2023. the deadline to file any discovery-related nondispositive motion is 11/24/2023. The deadline to file any dispositive motions is 8/24/2023. Parties have agreed upon John R. Van Winkle as mediator. The parties are authorized to mediate until 1/8/2024. This case is now SET for a Telephonic Scheduling Conference before the Honorable Michael G. Gotsch, Sr. to select a trial date and to set other pretrial deadlines on 12/5/2023, at 11:30 a.m. EST.
