November 27, 2023 Opinion or Order Filing 14 SCHEDULING ORDER: The Court ADOPTS by reference the parties report presenting agreed discovery plan and enters the instant Rule 16(b) Scheduling Order as follows: The parties will exchange the information required by Fed. R. Civ. P. 26(a)(1) by 12/11/2023. The parties report that no amendments to the pleadings are contemplated. Accordingly, any amendments to the pleadings must be by motion and leave of court. The serving of reports from retained experts under Rule 26(a)(2) are due from plaintiff(s) by 5/17/2024; and from defendant(s) by 7/9/2024. Supplementation under Rule 26(e) is due every six weeks until trial. The last date for the completion of ALL DISCOVERY is 9/13/2024. The deadline to file any discovery-related nondispositive motion is 8/16/2024. The deadline to file any dispositive motions is 10/14/2024, with any response due 28 days thereafter and any reply due 14 days after the filing of a response, consistent with N.D. Ind. L.R. 56-1(b)-(c). The parties shall name a mediator no later than 1/5/2024. The deadline for the parties to engage in mediation is 10/4/2024. The parties having consented to the undersigned Magistrate Judge pursuant to 28 U.S.C. 636(c), the Court hereby VACATES the Preliminary Pretrial Conference scheduled for November 29, 2023, at 10:45 a.m. EST. This case is now set for a telephonic scheduling conference before the Honorable Michael G. Gotsch, Sr. to select a trial date and to set other pretrial deadlines on 9/13/2024 at 11:00 AM in US District Court - South Bend.
