January 25, 2019 Opinion or Order Filing 3 ORDER DISMISSING COMPLAINT AS DUPLICATIVE AND DIRECTING ENTRY OF FINAL JUDGMENT - The complaint filed in this action is identical to the complaint filed in Sims v. Temple, et al., 1:18-cv-3419-JMS-DML on November 5, 2018. There is no reason for duplicative lawsuits which drain scarce judicial resources. Accordingly, this action is dismissed without prejudice. See McReynolds v. Merrill Lynch & Co., Inc., 694 F.3d 873, 888-89 (7th Cir. 2012) (a district court has broad discretion to dismiss a complaint if it duplicates another federal case, such as when the "claims, parties, and available relief do not significantly differ between the two actions.") (internal quotation omitted). Because the complaints filed in each action are identical and the other complaint was filed first in time, this action is dismissed.
