April 30, 2019 Opinion or Order Filing 6 Order to Show Cause - Discipline Case - Larry Gentry's amended petition for a writ of habeas corpus, filed on April 25, 2019, challenges his disciplinary conviction in ISF 17-05-0406 on September 6, 2018. Dkt. #4 . The second amended petition, filed on April 29, 2019, dkt. #5 , is a duplicate of the amended petition filed on April 25, 2019. The clerk shall strike the second amended petition from the docket. The petitioner shall have through May 30, 2019, in which to either pay the $5.00 filing fee for this action or demonstrate his financial inability to do so. The petitioner's custodian is directed to answer the allegations of the petitioner's amended petition for a writ of habeas corpus and in doing so shall show cause why the relief sought by the petitioner should not be granted insofar as the petitioner challenges the deprivation of a recognized liberty interest affecting the fact or the duration of his confinement. This shall be done within forty-two (42) days of the date this Entry is signed. The petitioner shall have twenty-eight (28) days after service of such answer or return to order to show cause on him in which to reply.If the petitioner's earliest possible release date (as reflected on the Indiana Department of Correction's website) is more than 1-year after the date the Return to Order to Show Cause is due, the Respondent is permitted to file a "Notice of 42-day Extension by Respondent (Habeas cases only)" which will extend the Respondent's deadline for filing a Return to Order to Show Cause by 42-days from the date the Notice is filed. The Notice must include the petitioner's anticipated release date if the relief sought by the petitioner is granted. Although additional motions for time are not anticipated, all subsequent motions for time must include the petitioner's anticipated release date if the relief sought by the petitioner is granted. March 29, 2019 Filing 3 ENTRY DIRECTING PETITIONER TO SUPPLEMENT PETITION - The Court has received the petitioner's petition for habeas corpus relief. In the petition, the petitioner alleges that he has served two sets of sanctions as a result of disciplinary case number ISF 17-05-0031. See dkt. #1 at 1. However, the sanctions imposed in disciplinary case number ISF 17-05-0031 were vacated, and the petition for writ of habeas corpus challenging that disciplinary hearing was dismissed as moot. See Case No. 2:17-cv-00535-JRS-DLP, dkt. 23 . To the extent the petitioner is challenging the re-hearing that occurred after the original sanctions were vacated, the petitioner has not identified the case number for that disciplinary hearing, nor has he stated the grounds on which he is challenging that disciplinary hearing. The petitioner shall have through April 29, 2019, in which to file an amended petition for writ of habeas corpus that clearly identifies the disciplinary case number, the sanctions imposed, and the grounds on which the petitioner is challenging the disciplinary hearing. The clerk shall include a copy of the Court's form Petition for Relief From a Prison Disciplinary Conviction with the petitioner's copy of this Entry.
