December 15, 2020 Opinion or Order Filing 7 ORDER - Dismissing Complaint and Directing Further Proceedings; The complaint names eight defendants: Dushan Zatecky, C. Jackson, Christina Conyers, C. Tyler, Officer Brogan, Officer Baker, Medical Staff, and UTM Arnold. The plaintiff alleges that on January 27, 2020, he was housed in the protective custody unit. Because Wexford acts under color of state law by contracting to perform a government function, i.e., providing medical care to correctional facilities, it is treated as a government entity for purposes of Therefore, to state a cognizable deliberate indifference claim against Wexford, the plaintiff must allege that he suffered a constitutional deprivation as a result of an express policy or custom of Wexford. The complaint makes no such allegations. The plaintiff's complaint must be dismissed for each of the reasons set forth above. The plaintiff shall have through January 12, 2020, in which to show cause why Judgment consistent with this Order should not issue or to file an amended complaint that corrects the deficiencies noted in this Order.
