Filing 9 Order Granting Motion to Proceed In Forma Pauperis, Screening Complaint, and Directing Service of Process - The plaintiff's motion to proceed in forma pauperis, dkt. #3 , is granted. The plaintiff is assessed an initial partial filing fee of Twenty Eight Dollars and Seventy Six Cents ($28.76). He shall have through November 06, 2018, to pay this sum to the clerk. The complaint has been screened and the Eighth Amendment claims set forth above shall proceed as submitted. If the plaintiff believes that additional claims were alleged in the complaint, but not identified by the Court, he shall have through November 05, 2018, in which to identify those claims. The clerk is ordered pursuant to Fed. R. Civ. P. 4(c)(3) to issue process to defendants Wexford, Dr. Byrd, and Kim Hobson in the manner specified by Rule 4(d). Process shall consist of the complaint, dkt. #2 , and motion for temporary restraining order, dkt. #5 , applicable forms (Notice of Lawsuit and Request for Waiver of Service of Summons and Waiver of Service of Summons), and this Entry. The defendants are notified that simultaneously with the filing of their answer, they are also ordered to file a response to the plaintiff's motion for temporary restraining order/motion for preliminary injunction.
