Order Granting Motion for Extension of Time, Denying Motion to Remand, Discussing Plaintiff's Restricted Status, Vacating Stay of Proceedings, and Directing Filing of Complaint - Plaintiff David Pannell's January 9, 2019, out- of-time motion for an extension of time, dkt. #9 , is granted. Mr. Pannell's response filed January 9, 2019, is deemed timely. The January 9, 2019, motion to remand, dkt. #11 , is denied. Defendants complied with all statutory requirements for remand at the time the remand was executed. This action shall proceed to the screening stage required by 28 U.S.C. 1915A. An order screening the complaint shall enter in due course. The stay of proceedings ordered on December 7, 2018, is vacated. The clerk is directed to file as a separate docket entry plaintiff's state court complaint, dkt. 1-3, which will be the operative complaint in this action. (See Order.) Order to Show Cause and Directing Stay of Proceedings - Plaintiff David Pannell, an inmate incarcerated by the Indiana Department of Correction (IDOC), is a frequent federal court litigant under a current filing restriction ordered by the United States Court of Appeals for the Seventh Circuit. The parties are directed to show cause why this action should proceed or not proceed in light of the Seventh Circuit's 2017 Mack sanction imposing filing restrictions on Mr. Pannell. The parties shall file briefs, no longer than ten pages in length, responding to this Show Cause Order no later than twenty-one days after this Order is signed. The briefs shall not address the merits of the complaint. Except for the briefing directed in this Order, this action is stayed until further notice. (See Order.) Copy to Plaintiff via U.S. Mail.
