Filing 5 ORDER DISMISSING COMPLAINT AND DIRECTING FURTHER PROCEEDINGS - The complaint, dkt. #1 , is dismissed for failure to state a claim upon which relief may be granted. Mr. Ogle will have through August 26, 2022, to file an amended complaint that resolves the deficiencies discussed in this Order. If Mr. Ogle files an amended complaint, it must be labeled "amended complaint" and include the case number, no. 2:22-cv-00286-JRS-MJD. The amended complaint will completely replace the original and must set forth all claims, defendants, and allegations Mr. Ogle wishes to pursue in this action. Mr. Ogle will also have through August 26, 2022, to pay the $402.00 filing fee for this action or demonstrate that he lacks the financial ability to do so by filing a motion for leave to proceed in forma pauperis. If Mr. Ogle fails to take these actions in the time provided, the Court will dismiss this action without further warning or opportunity to show cause and enter final judgment. (SEE ORDER.)
