The court grants the motion to the extent that Becker may not hold Elfreich liable under Counts IV or VI of the Amended Complaint for unleashing Axel with instructions to b ite and hold him; Becker may not hold the City liable under Count VI on the theory that deficiencies in SOP 359.00 caused injuries he sustained as a consequence of being bitten by Axel; and Becker may not hold the City liable under Count V for failin g "to establish a policy that ensured the K-9 would not engage (bite) suspects if the suspect was not resisting, fleeing or endangering the safety of an officer or the public."
