Filing 12 ENTRY REGARDING PLAINTIFF'S CORRESPONDENCE - Plaintiff wrote a "correspondence" to this court, requesting that the court hear his case. The court has heard his case and entered final judgment on the grounds that the suit was frivolous. There is nothing more to be done in this case because "a suit dismissed on the ground that it is frivolous normally cannot be refiled." Plaintiff appears to ask the court to reconsider its decision in another case, No. 3:20-cv-00285-RLY-MPB. In that case, the court gave Mr. Breneman two opportunities to file an amended complaint, but both times he failed to do so within the time allowed. The court appreciates Mr. Breneman's respectful correspondence, but there is nothing more to do in either of his cases because final judgments were entered in both. No new suit can be filed with the same jurisdictional defect--namely, frivolity. SEE ORDER. Copy to Plaintiff via US Mail. Signed by Judge Richard L. Young on 11/3/2021.(AAS) |
