ORDER granting 3 Partial Motion to Dismiss filed by American Family Mutual Insurance Company. Count II is hereby dismissed for failure to state a claim upon which relief may be granted. As to Count III, Plaintiff may file an amended com plaint by 5/2/2018. If Plaintiff does not file an amendment by that date, Count III will be dismissed.
