Filing 18 ORDER on Cross-Motions for Summary Judgment - Plaintiff's 14 MOTION for Summary Judgment is denied in its entirety. Defendants' 13 MOTION for Summary Judgment is granted with regard to Counts I through VII of the complaint. Those coun ts are dismissed with prejudice and judgment on those counts shall enter in favor of Sease and against Lynch. Defendants' 13 MOTION for Summary Judgment is denied with regard to the remaining counts (VIII through XXI) of the complaint. However , because all of the remaining counts are state law claims over which this court declines to exercise supplemental jurisdiction, they are dismissed without prejudice.
