MEMORANDUM OPINION AND ORDER granting in part and denying in part 2 Motion to Vacate/Set Aside/Correct Sentence (2255). Granted with respect to petitioner's right to appeal in Case No. CR06-2056, but denied as to the remedy he requests and in all other respects. Petitioner's sentence in Case No. CR06-2056 will be vacated, and a re-sentencing hearing will be set to re-impose the same sentence, in all respects, thereby restarting his time to appeal his sentence.
