ORDER: Plaintiff's motions to proceed in forma pauperis (22-CV-2009-CJW, 22-CV-2010-CJW, Doc. 1; 22-CV-2013-CJW, Doc. 1) are granted. The Clerks office is directed to file the complaints in 22-CV-2010-CJW, Doc. 1-1, and 22-CV-2013, Doc. 1-1 without the prepayment of fees. Petitioners pro se Section 2254 petition (22-CV-2009-CJW, Doc. 1) is dismissed with prejudice because it is untimely. A certificate of appealability will not issue. Petitioners motion to appoint counsel in 22-CV-2009-CJW is denied as moot. Plaintiff's case 22-CV-2005-CJW is dismissed without prejudice. Plaintiff's case 22-CV-2010-CJW is dismissed without prejudice. To the extent plaintiff is seeking injunctive relief in 22-CV-2013-CJW, that claim is denied as moot. Plaintiff is given 30 days from the date of this order to file an amended complaint in 22-CV-2013-CJW. If plaintiff fails to file an amended complaint in 22-CV-2013-CJW, his remaining claims will be dismissed with no further order of the Court for failure to state a claim.
