Filing 7 ORDER: 1) Martinez's #6 Motion for Leave to Proceed in forma pauperis is GRANTED . Section 1915(b)(1) requires a prisoner-plaintiff to pay the $350 filing fee as set forth below; 2) Within 28 days Martinez must pay $13.09 to the clerk as an initial partial filing fee; 3) the clerk shall open an account in Martinez's name for receipt of filing fee. The clerk shall complete a Notice Payment Form (Form 525) with (a) Martinez's name, (b) his inmate registration number and (c) this case number. The clerk shall serve a copy of this Order and the Notice of Payment Form upon the Jailer/Warden of the institution where Martinez is currently confined and upon the Office of General Counsel for the Dept of Corrections in Frankfort, KY; 4) Each month Martinez's custodian shall send the clerk a payment in the amount equal to 20% of his income for the preceding month out of his inmate trust fund, but only if the amount in the account exceeds $10. The custodian shall continue such monthly payments until the entire $350 is paid; 5) Martinez must immediately advise the Clerk of any change in his current mailing address.
