Filing 6 MEMORANDUM OPINION & ORDER : 1) Redd's motion ifp #5 is GRANTED. Prisoner-plaintiff is required to pay the $350 as set forth below: (1) the financial documentation Redd filed indicates that he lacks sufficient income to pay the initial partial filing fee and such fee is DEFERRED; b) The clerk shall open an account in Redd's name and shall complete the Form EDKY 525 and serve a copy of this Order and that form upon the Jailer/Warden of the institution where Redd is currently confined; c) Each month Redd's custodian shall send the clerk a payment equal to 20% of his income for the preceding month but only if that amount exceeds $10. and shall continue until the entire $350 is paid; 2) Redd's Complaint is DISMISSED for failure to state a claim upon which relief may be granted: (a) Redd's 4th and 8th Amendment claims are DISMISSED WITHOUT PREJUDICE; b) Redd's 5th Amendment claim is DISMISSED WITH PREJUDICE; 3) This action is DISMISSED and STRICKEN from the Court' docket; 4) Judgment shall be entered contemporaneously herein.
