ORDER: Manuel may PROCEED on his constitutional claims against: Anthony Higgins, Robert Williams, and Francisco Rios; 2. Manuel may PROCEED on his FTCA claim, and the Clerk's Office shall ADD the USA as dft; 3. Clerk shall PREPARE 5 "Service Packets". Each Service Packet shall include: a) completed summons form; b) Complaint #1 ; c) Order; d) USM Form 285; 4. Clerk shall send the Service Packets to USMS and not the date of delivery in text; USMS shall serve Higgins, Williams, and Rios at FMC in Lexington, KY; 6. USMS shall serve USA by cert. mail and the USAG by cert. mail; 7. Manuel must immediately adv Clerk's Office of any address change; 8. ORDER: 1) Manuel's #5 Motion for Leave to Proceed IFP is GRANTED. Payment of the $50.00 adm fee is WAIVED. Manuel must pay the $350.00 filing fee in the manner set forth below. 2) W/in 30 days from the entry of this Order, Manuel must pay $43.46 to the Clerk of this Court as an initial partial filing fee. 3) Clerk to open an account in Manuel's name for receipt of the filing fee. A Notice of Payment Form with (a) Manuel's name, (b) his inmate registration number, and (c) this case number shall be sent to the Warden of the Institution in which Manuel is currently confined. 4) Each month Manuel's custodian shall send to Clerk of the Court a payment in amount equal to 20% of Manuel's Inmate trust fund account. 5) Manuel must also keep the Clerk of this Court apprised of any change in his address. 6) This matter now stands submitted for initial screening pursuant to 28 U.S.C. 1915A and 1915(e)(2). ORDER: Accordingly, it is ORDERED as folows: 1) Clerk's Office to send Manuel an Application to Proceed IFP & Certificate of Inmate Account Form. 2) W/in 30 days from the entry of this Order, Manuel must either (a) pay the $400.00 in filing & Adm fees or (b) ask to pay the filing fee in installments over time by completing and filing both the AO-240 & EDKy 523 Forms. 3) If Manuel fails to take the foregoing steps w/in the time allotted, the Court will dismiss his case w/out prejudice for failure to prosecute. 4) Finally, Manuel must keep the Clerk's Office informed of his current address.
