June 14, 2023 Opinion or Order Filing 7 ORDER: 1. The Clerk's Office shall TERMINATE the Director of the Federal Bureau of Prisons as a Respondent in this proceeding. 2. The Clerk of Court shall send a copy of Minotta Cuero's petition (DE #6 , including attachments), as well as this Order, via certified mail to both (a) Respondent Swaney, Warden at the FCI in Manchester, KY, and (b) the US Attorney for the Eastern District of Kentucky. 3. W/in 60 days of the entry of this Order, the Respondent shall file a response to Minotta Cuero's petition. 4. W/in 30 days after the Respondent files his response, Minotta Cuero may file a reply brief in further support of his petition. 5. The Court DIRECTS the Clerk's Office to send Minotta Cuero the following forms: a. Petition for a Writ of Habeas Corpus under 28 U.S.C. 2241 [E.D. Ky. 521 Form]; b. Application to Proceed in District Court Without Prepaying Fees or Costs [AO 240 Form]; and c. Certificate of Inmate Account Form [E.D. Ky. 523 Form]. 3. Within 30 days from the date of this Order, Minotta Cuero must (a) complete the E.D.Ky. 521 Form in its entirety and file it with the Court; and (b) either pay the $5.00 filing fee to the Clerk's Office or properly move for leave to proceed in forma pauperis by completing and filng both the AO 240 and E.D.Ky. 523 Forms. 4.
