ORDER: 1. Dixon's motion to proceed in forma pauperis #7 is GRANTED. 2. Because Dixon has been granted pauper status in this proceeding, $52.00 administrative fee is waived. District Court Miscellaneous Fee Schedule require a prisoner to pay $350.00 filing fee as set forth below. 3. Clerk shall open an account in Dixon's name for receipt of filing fee. Clerk shall complete a Notice of Payment Form and send Notice and a copy of this Order to warden of institution in which Dixon is confined. 4. Collection of initial partial filing fee is DEFERRED. 5. For each month hereafter his custodian shall deduct from Dixon's inmate account an amount equal to 20% of his income for preceding month and remit that sum to Clerk. ORDER: 1. Dixon's motion to proceed in forma pauperis (R. #3 ) is DENIED WITHOUT PREJUDICE. 2. Clerk will mark assigned case number on (a) an affidavit of assets/in forma pauperis application [Form AO-240]; and (b) a Certificate of Inmate Account [EDKY Form 523] and send them to Dixon. 3. Should Dixon wish to pursue this federal action, he must either pay $350 filing fee and $50 administrative fee or (1) have the Certificate of Inmate Account certified by prison staff, (2) complete the Affidavit of Assets/In Forma Pauperis Application, and (3) file both of these documents with this Court. 4.
