Filing 9 ORDER re 3 EX PARTE MOTION for Attachment & Trustee Process filed by FRESCO'S MALDEN INC. On June 24, 2020, I held a telephonic hearing on the plaintiff's motion for attachment (ECF No. 3) with Attorneys Darling and Quinn for the plaintiff and Attorney Joseph Baldacci for the defendants. The defendants have not been served, but Attorney Baldacci stated that he had received copies of the complaint and motion for attachment from the plaintiff and had been retained by the defendants to participate in the hearing on their behalf, appearing specially. Also present by telephone was George Lambos, the plaintiff's owner. At the outset, Attorney Baldacci indicated his understanding that the individual defendants, Patricia and Kjell Lindau, and perhaps the corporate defendant, Northeast Abacus, Inc., intended to file for bankruptcy in the next few days and requested that the defendants be given until Monday, June 29, 2020, for such bankruptcy petition to be filed. After discussion, and without objection from the defendants, I ORDERED that, absent the filing of a petition in bankruptcy by all defendants, any opposition to the plaintiff's motion for attachment be filed by the defendant(s) by 4:30 p.m. on Monday, June 29, 2020, and that any reply be filed by the plaintiff by Wednesday, July 1, 2020.
