Filing 5 ORDER re 2 Motion for Preliminary Injunction; 2 Motion for TRO - On February 9, 2023, Joseph Roussel filed a complaint in this Court against William Mayo and Robert Young, alleging deprivation of his First Amendment rights. Compl. (ECF No. 1). The case caption states: Complaint for Damages & Motion for Temporary Restraining Order and Preliminary Injunction. Id. at 1. In his prayer for relief, however, Mr. Roussel does not request a temporary restraining order, only a preliminary and permanent injunction. Id. at 14 ("WHEREFORE, plaintiff respectfully prays that this court enter judgment granting plaintiff... [a] preliminary and permanent injunction ordering Defendants William Mayo, and Robert Young to cease engaging in conduct that deprives a citizen of the United States their right to enjoy meaningful access to the Court and to redress their government for the redress of grievances"). As Mr. Roussel does not demand a temporary restraining order for relief, the Court STRIKES this reference to temporary restraining order from the case caption and will proceed with his request for a preliminary and permanent injunction as soon as Mr. Mayo and Sherriff Young have been served and entered their appearances.
