Filing 6 ORDER denying 2 Motion for Recusal. Essentially for the same reasons set forth in Magistrate Judge Nivison's June 27, 2023 order, I deny Jeffrey Paul Barnard's request for me to recuse myself from this habeas corpus petition. Although I have presided over several matters involving Mr. Barnard, this fact alone does not justify my recusal. As Magistrate Judge Nivison quoted, the First Circuit has ruled that a judge has a duty not to recuse himself or herself if there is no objective basis for recusal. In re United States, 441 F.3d 44, 67 (1st Cir. 2006). Applying this standard to Mr. Barnard's motion, I conclude that Mr. Barnard has presented no objective basis for my recusal. By JUDGE JOHN A.
