After discussion with counsel, I declined to extend the proposed pretrial deadlines to the full extent requested because of the nascent stage of these proceedings and because I indicated that the parties may return to the court, if necessary, at a later stage to enlarge pretrial deadlines further, so long as discovery has been pursued diligently and articulable reasons for further extensions can be put forth. Accordingly, the court's proposed scheduling order is amended as follows: the parties may take up to 12 depositions per side; the deadline for amendment of pleadings and joinder of parties and for the plaintiffs to designate their experts is enlarged to August 28, 2009; the deadline for the defendants to designate their experts is enlarged to October 2, 2009; the discovery and Local Rule 44 records identification deadline is extended to November 13, 2009; the deadline for dispositive/Daubert/Kumho motions is reset to December 4, 2009; the plaintiffs and the defendants shall exchange written settlement demands and responses thereto on October 16 and October 30, 2009, respectively; and the case shall remain on the court's January 4, 2010, trial list. Counsel reported that they will exchange initial disclosures by May 11, 2009, initiate written discovery immmediately thereafter, and begin taking depositions in late June or early July.
