SUPPLEMENTAL ORDER granting in part #17 Motion for Leave to File. A telephonic hearing was held today at my request to discuss that part of Docket No. 17 on which I previously reserved ruling. See Docket No. 20. Participating were Justin Leary, Esq., for the plaintiffs and Joseph Crimmins, Esq., for the defendant. The defendant's unopposed motion to file its Daubert motion and exhibits under seal was previously granted, provided that the defendant file a redacted, public version of its motion by February 10, 2010. The defendant did not file a motion with incorporated memorandum, but rather a separate motion and memorandum. The motion was publicly filed, Docket No. 21, but the defendant's memorandum was filed under seal. Docket No. 22. After discussion, the defendant's deadline for filing a redacted version of its supporting memorandum, Docket No. 22, in the form submited to the court, is extended to February 12, 2010, and all exhibits attached to said memorandum shall be sealed. The court finds that the redacted portions of the defendant's memorandum and its exhibits contain material of a highly personal and sensitive nature, and that the harm to the plaintiffs' privacy of the disclosure of such information would outweigh the public's interest in such redacted information.
