On May 18, 2021, I held a conference with Attorneys Webbert, Powell, Stephens, and Leighton for the plaintiff, and Attorneys Kavouras and Strawbridge for defendant InfoCision, Inc., on the parties' status reports detailing how they believe this case should proceed (ECF Nos. 55, 56, 58, 59). Specifically at issue was the plaintiff's request for discovery on the threshold issue of whether the technology that InfoCision used to call him meets the definition of an automatic telephone dialing system (ATDS) as set forth in the Telephone Consumer Protection Act, 47 U.S.C. 227(a)(1), and as recently clarified by the Supreme Court in Facebook, Inc. v. Duguid, 141 S. Ct. 1163 (2021). The parties disagreed whether it was appropriate to proceed with such discovery in light of InfoCision's anticipated motion for judgment on the pleadings, in which it intends to assert that the plaintiff's remaining counts fail to state a claim under the test established by Facebook, Inc. After hearing extensive argument from both sides, I determined that it would be helpful to have further briefing on the propriety of permitting the discovery requested by the plaintiff, see ECF No. 55 at 6, at this juncture in the case. Accordingly, I ORDERED the parties to prepare and submit simultaneous briefs of no more than 7 pages by May 28, 2021, with simultaneous response briefs of no more than 4 pages to be submitted by June 4, 2021. Because the defendants' motions address all the plaintiff's claims and are soon to be argued before the court on December 11, 2020, (see ECF No. 45) I determined that a revised scheduling order should not be entered, and that discovery should not proceed, until the motions are resolved. The court's rulings on the motions will provide significant guidance for any future scheduling order and may narrow or eliminate the parties' disagreements regarding the scope of discovery. Accordingly, I GRANTED the defendants' objection (ECF No. 38) and VACATED the current scheduling order (ECF No. 32) pending resolution of the defendants' motions to stay and to dismiss (ECF Nos. 17, 31). I correspondingly DENIED the plaintiff's objection (ECF No. 39).
