MINUTE ORDER. The Court is in receipt of Petitioner O'Melveny & Myers, LLP's #2 Motion to Transfer. Petitioner O'Melveny & Myers moves for the transfer of Petitioners' Joint Motion to Quash Subpoenas to the United States District Court for the District of Maryland, the Court from which the challenged subpoenas were issued. Federal Rule of Civil Procedure 45(f) states that "[w]hen the court where compliance is required" -- in this case, the District of Columbia -- "did not issue the subpoena, it may transfer a motion under this rule to the issuing court" -- in this case, the District of Maryland -- "if the person subject to the subpoena consents or if the court finds exceptional circumstances." All of the Petitioners who are subject to the challenged subpoenas consent to the transfer of their pending Joint Motion to Quash to the District of Maryland. By no later than AUGUST 9, 2018, Respondent iStar Financial, Inc. shall file a response to this Motion explaining why, given the plain text of Rule 45 and Petitioners' consent, Petitioners' Motion should not be transferred.
