ORDER - Defendant's motion for summary judgment 11 is GRANTED as to the issues of laches and the statute of limitations. The remainder of defendant's motion is DENIED WITHOUT PREJUDICE. Defendant's motion to strike brief 20 is DE NIED. This matter is REMANDED to the United States Department of Agriculture for application of the correct standard for determining whether plaintiff was "actively engaged in farming" during the time period relevant to this action.
