REPORT AND RECOMMENDATION: that Plaintiffs' Motion to Dismiss Counterclaim of William L. Jorgensen and Bruce A. Jorgensen Doc. No. 34 be GRANTED in part and DENIED in part as follows: 1. To the extent the Counterclaim is asserted against Prude ntial, the Motion to Dismiss should be GRANTED; 2. To the extent the Counterclaim is asserted against PREA, the Motion to Dismiss should be DENIED without prejudice; A. The Jorgensen Defendants should be given leave to amend their Counterclaim to add ress the deficiencies outlined in this Report and Recommendation within thirty (30) days; and B. PREA should not be prejudiced from bringing a motion to dismiss regarding the amended counterclaim. Objections to R&R due by 7/31/2009 Signed by Magistrate Judge Susan R. Nelson on 07/16/2009. (MMP)
