The counterclaim and third-party complaint are DISMISSED WITH PREJUDICE AND ON THE MERITS. The motion of plaintiff International Brotherhood of Teamsters, Graphic Communications Conference, Upper Midwest Local 1-M and third-party defendant Michael Ollig for summary judgment 5 is GRANTED IN PART and DENIED IN PART as follows: The motion is GRANTED insofar as it seeks an order from the Court compelling defendants to arbitrate the question of whether the Union is bound by the last-chance agreement; and the motion is DENIED in all other respects.
