Filing 38 ORDER. 1. No later than 60 days from the date of this Order, Majewski shall pay the Anastasi Defendants $1,168.75 and the Coldwell Banker Defendants $975.2. The Highland Defendants Motion to Dismiss (Doc. No. 22 ) is GRANTED IN PART. Count 1 (to the extent that it is based on HOEPA) and Count 5 against Highland Bank are hereby DISMISSED WITH PREJUDICE. Therefore, the remaining claims in this action are Counts 1 (to the extent that it is based on TILA), 2, 3,and 4 against Highland Bank and Counts 1-5 against Granite Mortgage & Construction Finance. 3. Majewski is instructed to properly serve Highland Bank and Granite Mortgage & Construction Finance within the time period proscribed in Federal Rule of Civil Procedure 4(m). Majewski is further instructed to file affidavits of service with the Court as required by Federal Rule of Civil Procedure 4(l). The Court hereby gives notice to Majewski that, pursuant to Rule 4(m), it will dismiss without prejudice the remaining 8 claims in this action if he fails to timely serve the remaining defendants and to file affidavits of service.
