ORDER: IT IS ORDERED THAT:1.The United States Motion for Summary Judgment [Docket No. 41] is GRANTED IN PART and DENIED IN PART.2.Judgment is entered in favor of the United States and against Joseph E. Steinmaus for federal income tax, interest, an d penalties for tax years 1994 to 1998 and 2002 to 2005 in the amount of $410,391.66 plus interest, statutory additions, and accruals from June 13, 2011, until the amount owing is paid.3.The United States has valid and subsisting federal tax lie ns that arose at the time of federal income tax assessments against Joseph E. Steinmaus for tax years 1994 to 1998 and 2002 to 2005, and that attached at the time of assessment to all property and rights to property held by Steinmaus, as well as to a ll of Steinmauss subsequently acquired property and rights to property, including the real property (Property) located at 7279 40th Street North, Oakdale, Minnesota, and described as follows:The East 200 feet of the North 435.60 feet of the Northwest Quarter of the Northwest Quarter (NW 1/4 of the NW 1/4) of the section Seventeen (17). Township Twenty-nine (29) North of Range Twenty-one (21) West.4.The United States is entitled to foreclose its federal tax liens for tax years 1994 to 1998 and 20 02 to 2005 against the Property. The Property will be sold pursuant to further Order of this Court. The United States shall submit a Proposed Order of Sale within sixty days of August 11, 2011. Steinmaus shall cooperate with the United States in its attempts to sell the Property.5.Paragraph 4 of this Order is STAYED for thirty days after August 11, 2011.LET JUDGMENT BE ENTERED ACCORDINGLY.(Written Opinion).
