MEMORANDUM OPINION AND ORDER. 1. Defendant's Motion to Dismiss (Doc. No. 3 ) is GRANTED with respect to Counts One, Two, and Three of Plaintiff's Amended Complaint (Doc. No. 29 ). 2. Counts One, Two, and Three of Plaintiff's Amended Complaint (Doc. No. 29 ) are DISMISSED WITHOUT PREJUDICE. 3. Within fourteen days, the parties shall contact Magistrate Judge Boylan's chambers to schedule an early settlement conference to attempt to resolve the parties' dispute with respect to Count Four.
