MEMORANDUM OPINION AND ORDER. Defendants' Motion for Summary Judgment (Doc. No. 38 ) is GRANTED IN PART and DENIED IN PART as follows: 1. Defendants are entitled to judgment with respect to Counts III, IV, V, and VI of Plaintiffs' Amended Complaint (Doc. No. 32 ). 2. Counts I and II of Plaintiffs' Amended Complaint (Doc. No. 32 ) remain for trial. 3. Defendants are entitled to judgment with respect to Count VII of Plaintiffs' Amended Complaint (Doc. No. 32 ) insofar as P laintiffs seek treble damages in connection with their RICO claim. To the extent Count VII seeks punitive damages with respect to Plaintiffs' claims of race discrimination, the damage claim remains for trial. (Written Opinion). Signed by Judge Donovan W.
