MEMORANDM OPINION AND ORDER granting in part and denying in part defendant's 47 Motion for Summary Judgment as follows: (1) The motion is granted with respect to the causes of action for breach of warranty (Cou nt 3) and negligence (Count 4). These claims are dismissed with prejudice.
