Keyes's November 5, 2012 Report and Recommendation are OVERRULED. 2. Magistrate Judge Jeffrey J. Keye s's November 5, 2012 Report and Recommendation (Doc. No. 6 ) is ADOPTED. 3. Plaintiff Michael Collins Iheme's motion to be excused from paying an initial partial filing fee (Doc. No. 5 ) is GRANTED. 4. Plaintiffs application for leave to proceed in forma pauperis (Doc. No. 2 ) is DENIED.5. This action is summarily DISMISSED pursuant to 28 U.S.C. § 1915A(b)(1).6. Plaintiff Michael Collins Iheme is required to pay the unpaid balance of theCourt filing fee, namely the full $350, in accordance with 28 U.S.C. § 1915(b)(2).7.
