ORDER granting in part and denying in part 77 Motion for Summary Judgment; denying 85 Motion for Partial Summary Judgment. IT IS HEREBY ORDERED THAT: 1. Plaintiff's motion for partial summary judgment 85 is DENIED. 2. Defendants 9; motion for partial summary judgment 77 is GRANTED IN PART and DENIED IN PART as follows: a. Defendants' motion is GRANTED as to the following claims, and those claims are DISMISSED WITH PREJUDICE AND ON THE MERITS: i. Count III, insofar as it asserts a claim for failure to render first aid; ii. Counts VI, VII, VIII, IX, X, and XI, insofar as they are based on the actions of McDonough before he arrested Scheffler; and iii.Counts XIV, XV, XVI, and XVII. b.
