ORDER denying as moot 5 Motion to Dismiss and 14 Motion to Dismiss; granting in part 35 Motion to Dismiss and 37 Motion to Dismiss. The Motions are GRANTED as to Brinkman's Title VII claims (Counts I and III of the Amended Complaint) , and those claims are DISMISSED WITH PREJUDICE. The Court declines to exercise supplemental jurisdiction over Brinkman's state-law claims (Counts II and IV of the Amended Complaint), and those claims are DISMISSED WITHOUT PREJUDICE.
