ORDER granting in part 39 44 Motions for Judgment on the Pleadings. IT IS HEREBY ORDERED THAT: 1. Defendants' motions for judgment on the pleadings [39, 44] are GRANTED IN PART as follows: a. Counts I, III, IV (breach of implied warr anty of fitness for particular purpose), V, and VI are DISMISSED WITH PREJUDICE. b. Counts II, IV (rejection of delivery right to full replacement), and VII are DISMISSED WITHOUT PREJUDICE. 2.
