The parties have agreed to engage in private mediation in this matter and have scheduled that mediation for October 24, 2018. In light of that plan, they have jointly requested that the Court cancel the Pretrial Conference currently scheduled for 9/24/18 and reschedule it, if necessary, following the mediation. The Court agrees that this approach makes sense and commends the parties on working toward an early and efficient resolution of this litigation. On or before 11/1/18, counsel must update the Court regarding whether or not the matter was settled at the mediation. Upon receipt of that update, the Court will reset the Pretrial Conference or hold a status conference if necessary. The Pretrial Conference scheduled for 9/24/18 is CANCELED.
