February 20, 2019 Opinion or Order Filing 5 ORDER denying #2 Motion to Expedite. 1.Respondent is directed to file an answer to the petition for a writ of habeas corpus of Petitioner Karlis Ray Baisden within 21 days of this Order certifying the true cause and proper duration of Baisden's confinement and showing cause why the writ should not be granted in this case. 2.Respondent's answer must be simultaneously served upon Petitioner.3. Respondents answer should include: a. Such affidavits and exhibits as are needed to establish the lawfulness and correct duration of Baisden's incarceration, in light of the issues raised in the petition; b. A reasoned memorandum of law and fact fully stating respondent's legal position on Baisden's claims; and c. Respondent's recommendation on whether an evidentiary hearing should be conducted in this matter.4. Respondent must address the merits of Baisden's Petition regardless of whether Respondent believes that the Petition should be dismissed for failure to exhaust administrative remedies. 5. If Baisden intends to file a Reply to Respondent's answer, he must do so within 30 days of the date when the answer is filed. Thereafter, no further submissions from either party will be permitted, except as authorized by Court Order. 6. Baisden's Motion to Expedite Proceedings, [Docket No. 2], is DENIED. All habeas corpus proceedings are entitled by statue to higher priority than other non-emergency civil litigation. Based on the information in Baisden's Motion, this matter may be resolved in sufficient time, given the briefing schedule established above, to afford Baisden all appropriate relief to which he might be entitled without further expediting the proceedings.
