August 27, 2019 Opinion or Order Filing 11 TEXT ONLY ORDER: This matter is before the Court on the August 12, 2019, update letter from Patrick Rooney on behalf of the parties in the matters of Townsend Bros. Ag Enterprises, LLC v. C.H. Robinson Co., 18-cv-03348 (PJS/HB) and Flowers Farms, LLC v. C.H. Robinson Co., 19-cv-1181 (PJS/HB), updating the Court on the parties' discussions regarding discovery and possible consolidation of all related matters at least for purposes of a partial motion for summary judgment. [Doc. Nos. 60 and 34, respectively.] The Court will hold a status conference by telephone with counsel in this and all related matters at 3:30 p.m. CDT on September 25, 2019, to discuss the parties' progress in resolving the issues and completing the discovery discussed in the letter, and to discuss the specifics of possible early consolidated cross-motions for partial summary judgment on one or more issues common to the related cases. The call will be conducted using a Conference Bridge. Chambers will circulate call-in instructions several days before the conference call. Counsel must meet and confer in advance of the call and e-file a joint update on or before September 23, 2019, including what discovery has been completed and a detailed proposal regarding early cross-motions for partial summary judgment in all related cases. That proposal must identify the specific issues to be addressed by such cross-motions and a proposed briefing schedule. If the parties have areas of disagreement as to the foregoing, the letter should describe their respective positions as to each such disagreement.
